These Website Terms of Use ("Terms") apply to the public website operated by ViaROS, LLC, a Delaware limited liability company ("ViaROS," "we," "us," or "our"), including viaros.com and related public website features, forms, scheduling links, subscriptions, and introductory communications.
By accessing or using the website, you agree to comply with these Terms to the extent a binding agreement is formed under applicable law. If you use the website on behalf of an organization, you represent that you have authority to act for that organization. If you do not agree with these Terms, do not use the website in a manner that requires agreement to them.
Scope and separate customer agreements
The website provides information about ViaROS, ROS, our approach, and examples of work; receives business inquiries and subscriptions; and provides links for introductory conversations and demonstrations. The website does not itself create a ROS subscription, implementation, support arrangement, proof of execution, service-level commitment, or other paid engagement.
Any paid service, implementation, proof, subscription, support arrangement, confidentiality obligation, or data-processing commitment is governed by the separate agreement applicable to that engagement. If a separate signed agreement conflicts with these Terms, the separate agreement controls for the subject it covers.
The website is intended for adult business professionals. It is not directed to children. A newsletter subscription, inquiry, meeting, or demonstration does not make you a customer of ROS or any other paid service.
Permitted use and restrictions
You may use the website for lawful business purposes, including learning about ViaROS, evaluating whether to engage with us, reading public materials, subscribing to requested communications, and contacting or meeting with us.
You may not:
- attempt unauthorized access to the website, its systems, accounts, or data;
- introduce malicious code, disrupt service, interfere with security, or circumvent access controls;
- impersonate another person or organization or knowingly provide materially false information;
- submit unlawful, infringing, malicious, or unauthorized content;
- harvest contact information from the website for unsolicited communications;
- use the website or its content in a way that violates applicable law or another party’s rights.
We may restrict or block activity that we reasonably believe threatens the website, violates these Terms, or creates a legal or security risk, subject to applicable law.
Website content and intellectual property
ViaROS or its licensors own or hold the rights necessary to use the website’s text, designs, diagrams, photographs, videos, software materials, branding, and other content. Third-party names, logos, and trademarks remain the property of their respective owners. Nothing on the website transfers ownership or grants a license to source code, ROS technology, or other nonpublic materials.
You may share links to public pages, print or retain reasonable copies for your organization’s internal evaluation, and quote brief excerpts from public written content with clear attribution to ViaROS. Full republication, commercial resale, distribution of substantial portions, or use of ViaROS names, logos, or marks in a way that suggests sponsorship or endorsement requires prior written permission unless applicable law independently permits the use.
Public descriptions, examples, proof, and AI content
Website descriptions summarize our approach and do not identify every technical dependency, integration requirement, limitation, implementation step, or delivery condition. Diagrams, examples, demonstrations, case studies, performance figures, and customer stories may reflect specific configurations, periods, and circumstances. A result achieved in one environment is not a guarantee that the same result will be achieved in another environment.
Scope, responsibilities, pricing, timing, acceptance criteria, service levels, warranties, and other commercial commitments are established only in a separate agreement. Public website content is not incorporated into a customer agreement unless that agreement expressly says so.
References to AI explain how business logic, execution history, or other permitted context may be used with an AI system. They do not guarantee that every AI system will produce a particular answer, recommendation, or action. Results depend on the selected AI, its configuration, available information, permissions, and use case. AI-generated output should be evaluated by appropriate people before being relied on for important business decisions.
Public website content is general business and technical information. It is not legal, financial, accounting, tax, or other regulated professional advice.
Inquiries, submissions, and confidentiality
Provide accurate business contact information and only material you are authorized to share. Do not use general website forms or introductory meetings to send passwords, financial-account information, government identifiers, sensitive personal information, regulated data, confidential production records, source code, or another party’s trade secrets unless ViaROS has agreed to an appropriate protected method.
An inquiry, meeting, demonstration, or submission does not by itself create a confidentiality obligation or nondisclosure agreement. If confidential information needs to be exchanged, the parties should put the appropriate confidentiality terms in place first.
You retain ownership of information and materials you provide. You authorize ViaROS to use and process them only as reasonably necessary to respond to the request, conduct the requested discussion, perform agreed follow-up, protect the website, and comply with law. Our Privacy Policy explains how we handle personal information.
Email subscriptions and MailerLite
ViaROS uses MailerLite to manage website contact and subscription information and to send requested ViaROS updates. A marketing subscription is voluntary and separate from meeting booking or other business correspondence. Our current subscription form uses email confirmation before a subscription becomes active.
You may unsubscribe from marketing communications at any time through the unsubscribe method in the message or by contacting info@viaros.com. Necessary replies to a request you made and communications related to an existing business relationship may continue as appropriate. MailerLite is a third-party service and its own terms and notices also apply to its independent activities.
Scheduling, Cal.com, and Google Meet
ViaROS uses Cal.com for public meeting scheduling and Google Meet for online meetings. Cal.com may connect with ViaROS-managed calendars so that availability can be shown and meetings can be created. Meeting details, availability, cancellations, and rescheduling may be updated by the parties. A booking is not acceptance of a paid engagement and does not create a service-level commitment.
With participants’ agreement, a meeting may be recorded, transcribed, or documented using built-in AI-generated meeting notes. If a participant does not agree, the meeting can proceed without those features. Meeting materials may be shared with people included on the invitation, including invited nonattendees, subject to the sharing permissions used for the file. AI-generated notes may contain errors and should be reviewed. Our Privacy Policy provides additional information.
Third-party services and links
The website and related interactions may use or link to third-party services, including Cal.com, Google services, MailerLite, and other external websites. Third-party services may have their own terms, privacy notices, availability, security practices, and limitations. A link does not necessarily mean ViaROS endorses all third-party content or practices. Nothing in this section removes ViaROS’s own obligations when we use a service provider on our behalf.
Privacy
Our Privacy Policy explains how ViaROS collects, uses, shares, retains, and protects personal information associated with the website, forms, subscriptions, scheduling, and business communications. Agreeing to these Terms is not blanket consent to marketing, optional analytics, meeting recording, or any other processing activity for which separate permission is required.
Website availability and disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PUBLIC WEBSITE AND ITS GENERAL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." VIAROS DOES NOT WARRANT THAT THE WEBSITE WILL ALWAYS BE AVAILABLE, ERROR-FREE, OR COMPLETELY ACCURATE, OR THAT PUBLIC CONTENT WILL BE SUITABLE FOR A PARTICULAR IMPLEMENTATION OR BUSINESS DECISION.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIAROS DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT AS THEY RELATE TO THE PUBLIC WEBSITE. These disclaimers do not override express commitments in a separate signed agreement or rights and warranties that applicable law does not permit us to exclude.
We may update, correct, suspend, or discontinue public website content or features without creating liability for a change to the public website, provided that doing so does not alter an existing signed customer agreement.
Limitation of website-related liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VIAROS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITY, OR GOODWILL, ARISING SOLELY FROM ACCESS TO OR USE OF THE PUBLIC WEBSITE, EVEN IF THE POSSIBILITY OF SUCH LOSS WAS KNOWN.
This section applies only to claims arising from the public website and these Terms. It does not limit obligations or liability governed by a separate customer agreement. Nothing in these Terms excludes or limits liability that applicable law does not allow to be excluded or limited, including liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence, or other non-waivable statutory rights.
Governing law and venue
Subject to mandatory law that cannot be displaced by agreement, these Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. For a dispute arising solely from these Terms or use of the public website, the parties consent to the state and federal courts located in Dallas County, Texas, unless applicable non-waivable law requires another available forum.
This section does not change the governing law, dispute process, or venue established in a separate customer agreement.
Changes to the website and these Terms
We may revise these Terms as our website, practices, or legal requirements change. We will post the revised Terms and update the date above. A change does not retroactively alter a signed customer agreement or remove a right that cannot lawfully be waived. Where applicable law requires additional notice or agreement for a particular change, we will provide it.
Miscellaneous
If a provision of these Terms is held unenforceable, it will be limited or severed only to the extent necessary, and the remaining provisions will continue to apply. A failure to enforce a provision is not a waiver. These Terms do not create an agency, partnership, employment, franchise, or joint venture relationship.
Translations may be provided for convenience and accessibility. Mandatory language and interpretation rights under applicable law remain unaffected.
